This Privacy Policy explains, clearly and transparently, how personal data related to the website lucianacnogueira.com.br is processed, in accordance with Brazilian Law No. 13,709/2018 (General Personal Data Protection Law, LGPD) and Law No. 12,965/2014 (Brazilian Internet Civil Framework, Marco Civil da Internet).
1. Controller and Data Protection Officer
The controller of the personal data processed through this website is Luciana Nogueira Sociedade Individual de Advocacia, CNPJ 40.711.513/0001-25, operating under the name LN Boutique Jurídica Estratégica, working nationwide, with a presence in Rio de Janeiro, São Paulo and Americana.
The person in charge of personal data processing (Data Protection Officer, encarregada) is Luciana Nogueira, who can be contacted at assessoria@lucianacnogueira.com.br, the channel for questions, requests and complaints about personal data.
2. Data processed
Data provided by the visitor. The website has no forms and does not require registration. Personal data only reaches the firm when the visitor decides to get in touch, by e-mail or WhatsApp, and may include:
- Name;
- E-mail;
- Phone number;
- Company;
- Content of the message and of any attached files.
Technical browsing data. To deliver the pages and protect the website against attacks, the hosting provider automatically processes technical information such as IP address, date and time of access, requested page and browser type. The firm does not keep its own database of these records and does not use them to identify visitors or build profiles.
The website is not directed at children or adolescents.
3. Purposes and legal bases
Personal data is processed only for the purposes below, under the corresponding legal bases of article 7 of the LGPD:
- Replying to messages, assessing the matter presented and providing the requested information about the firm's services, based on preliminary procedures related to a contract, at the data subject's request (art. 7, V);
- Maintaining the security and proper functioning of the website and preventing fraud, based on legitimate interest, limited to what is strictly necessary (art. 7, IX);
- Retaining communications to comply with legal or regulatory obligations and for the regular exercise of rights (art. 7, II and VI);
- Sending updates only to those who expressly request them, based on consent, which may be withdrawn at any time (art. 7, I).
4. Professional secrecy and sensitive information
Messages received are treated confidentially, in compliance with the duties of professional secrecy set forth in the Brazilian Bar Statute (Law No. 8,906/1994) and the Brazilian Bar Association's Code of Ethics and Discipline.
The first contact does not establish an attorney-client relationship. Visitors are therefore advised to describe their matter in general terms and not to send documents, sensitive personal data or third-party information before the engagement is formalized.
5. Data sharing
LN Boutique Jurídica Estratégica does not sell, rent or transfer personal data for commercial purposes. Sharing is limited to the service providers essential to the operation of the website and to communication, each within its own sphere:
- Amazon Web Services (AWS), responsible for hosting and securing the website;
- Microsoft, responsible for the firm's institutional e-mail service (Microsoft 365);
- WhatsApp, by Meta, through which messages sent via that app are transmitted, subject to WhatsApp's own policies;
- Google, responsible for YouTube, only when the visitor chooses to watch a video.
Personal data and records will only be provided to authorities by court order or in the other cases provided by law, pursuant to article 10 of the Marco Civil da Internet.
6. International transfer
The website files are stored on AWS servers located in São Paulo, and page delivery uses the AWS distribution network, with servers in Brazil and abroad. The providers listed above may store or process data on servers located outside Brazil. In such cases, the international transfer takes place under the hypotheses of article 33 of the LGPD, observing the regulations of the Brazilian National Data Protection Authority (ANPD Resolution CD/ANPD No. 19/2024) and the data protection safeguards set out in those providers' terms and policies.
7. Storage, retention and security
Messages sent by e-mail are received in the firm's institutional account, with access restricted to authorized persons. The website uses a secure connection (HTTPS), and the firm adopts technical and administrative measures capable of protecting personal data against unauthorized access and accidental or unlawful destruction, loss, alteration or disclosure, pursuant to article 46 of the LGPD.
Contact data is kept for as long as necessary to handle the request. If an engagement follows, it is retained for the duration of the professional relationship and for the applicable legal and limitation periods. If there is no engagement, it is deleted once no longer needed, except for the retention cases authorized by article 16 of the LGPD.
In the event of a security incident that may pose a relevant risk or harm to data subjects, the firm will notify the ANPD and the affected data subjects, pursuant to article 48 of the LGPD.
8. Data subject rights
Under article 18 of the LGPD and article 7 of the Marco Civil da Internet, data subjects may, at any time and upon request:
- Confirm the existence of processing and access their data;
- Correct incomplete, inaccurate or outdated data;
- Request the anonymization, blocking or deletion of unnecessary or excessive data, or data processed in breach of the law;
- Request data portability, in accordance with ANPD regulations;
- Obtain information about the entities with which their data has been shared;
- Withdraw consent, when consent is the legal basis for processing, and request deletion of the data processed on that basis, except for the cases in article 16 of the LGPD;
- Object to processing carried out on other legal bases, in the event of non-compliance with the LGPD;
- File a petition with the Brazilian National Data Protection Authority (ANPD).
Requests should be sent to assessoria@lucianacnogueira.com.br and will be answered within the time limits of article 19 of the LGPD. Confirmation of the requester's identity may be requested, for the data subject's own protection.
9. Cookies and similar technologies
The website does not use its own cookies or audience measurement, advertising or tracking tools, and does not load any third-party content when opened. The video covers are hosted on the website itself.
The YouTube player, in privacy-enhanced mode, is only loaded when the visitor clicks to watch a video. From that moment on, Google may use cookies and similar technologies in accordance with its own privacy policy. Links to videos, social networks and WhatsApp lead to third-party services governed by their own policies.
Visitors may, if they wish, block or delete cookies in their browser settings.
10. External links
The website contains links to third-party websites, such as social networks, YouTube and media outlets. LN Boutique Jurídica Estratégica is not responsible for the privacy policies or content of those websites.
11. Changes to this policy
This Privacy Policy may be updated to reflect legal, regulatory or operational changes to the website. The version in force is always the one published on this page, with the date of the last update shown at the top.
